Welcome to Habitat, a mobile application operated by Prodigy Studios LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application ("App") and website (gethabitat.co) (collectively, the "Services"). By signing up for or using our Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use our Services.

2. Eligibility & Accounts

2.1 Age Restrictions: Habitat is designed for families (ages 4+). By using our Services, you confirm that you are at least 18 years old or have obtained parental/guardian consent.

2.2 Account Creation: Each user may have only one account.

2.3 Account Security: You are responsible for maintaining the confidentiality of your login credentials. We are not responsible for unauthorized access due to negligence.

3. Subscriptions & Payments

3.1 Subscription Model: Habitat operates on a subscription-based model, with payments processed by Apple App Store and Google Play Store.

3.2 Refunds: We do not process refunds directly. All refund requests must comply with Apple's and Google's policies.

3.3 Subscription Management: Deleting your Habitat account does not cancel your subscription. Users must manually cancel via their respective app store settings.

4. Acceptable Use

By using Habitat, you agree not to:

• Use our Services for any illegal, harmful, or abusive activity.
• Attempt to hack, disrupt, or reverse-engineer any part of the Services.
• Share misleading or false information about our Services.

Failure to comply may result in suspension or termination of your account.

5. Data Collection & Privacy

Our data collection practices are outlined in our Privacy Policy. In summary:

• For Adults: We collect name, email, and usage data via Google Analytics.
• For Children: We only collect a first name or nickname (provided by a parent/guardian) and do not track analytics.
• Data Storage: We store user data securely using Supabase with access controls in place.

6. Limitation of Liability

To the fullest extent permitted by law:

• We do not guarantee uninterrupted, error-free, or completely secure operation of the Services.
• We are not liable for any indirect, incidental, or consequential damages arising from the use of Habitat.

7. Third-Party Services

Habitat integrates with Apple App Store, Google Play Store, Google Analytics, and Supabase. We are not responsible for the policies or actions of these third-party services.

8. Governing Law & Dispute Resolution

8.1 Governing Law: These Terms are governed by the laws of Texas, USA, without regard to conflict-of-law principles.

8.2 Arbitration Clause: Any dispute, controversy, or claim arising out of or relating to these Terms or our Services shall be resolved through binding arbitration under the rules of FairClaims.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. Updates will be communicated via an in-app alert. Your continued use of our Services after changes are made constitutes acceptance of the new Terms.
